When is an Affidavit needed?

Use an Affidavit when: you need to declare facts in writing before a court (as witness or party), apply for visa or residency and need proof of family relationship, your employer or landlord asks you to verify something formally, need to declare loss of documents (passport, car title), have to prove income or residence for public benefits, are disputing a bill or charge and need to state the facts. It is the strongest form of written statement in the US — lying in an Affidavit is perjury (federal crime).

California validity

In California, an Affidavit is valid when: (1) signed in the presence of a California notary public, (2) the notary verifies the declarant's identity with valid ID, (3) the statement uses "I declare under penalty of perjury under the laws of the State of California" or similar (Code of Civil Procedure §2015.5). A statement signed without notary is called a "Declaration under Penalty of Perjury" — also valid in many cases, but the notarized version (Affidavit) is stronger for international use or when extra certification is needed.

How to draft a valid Affidavit

1. 1. Identify the affiantFull legal name + address + ID number + mental state ("of legal age and sound mind"). The affiant is who swears — must be specific person, not entity.
2. 2. Establish authority to declareHow do you know the facts? "Personal knowledge", "Based on records I keep", "Based on conversations on dates X and Y". Affidavits without basis are rejected.
3. 3. State facts numberedEach fact in separate paragraph, numbered. Format: "1. On [date], at [location], I observed [fact]." No opinions, no legal conclusions, only verifiable facts.
4. 4. Limit to first person"I saw", "I heard", "I signed". Not "They said" (that's hearsay and rejected). If you need to state what someone said, be specific: "On [date], John Smith stated to me directly: 'X'".
5. 5. Attach documentary evidence"Attached as Exhibit A is a true and correct copy of [document]." Number and reference each exhibit. Without documentary evidence, your affidavit is just your word.
6. 6. Final penalty-of-perjury clauseMANDATORY: "I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct." Without this clause, the document is NOT a valid affidavit.
7. 7. Sign before notaryCalifornia requires notarization for affidavit. The notary verifies your identity and administers the oath. Cost: $15-25. Without notary, it is just a declaration, not an affidavit.

Common Affidavit mistakes

• ⚠Including opinions or legal conclusions"He was negligent" is a legal conclusion — leave it to the judge. "I observed him running a red light at 60mph" is fact. Affidavits with opinions are rejected as evidence.
• ⚠Hearsay (rumors)"My neighbor told me that..." is hearsay and rejected. Only state what you SAW, HEARD DIRECTLY, or READ yourself.
• ⚠Missing penalty-of-perjury clauseWithout this clause, your "affidavit" is just a letter without legal force. It is mandatory per California Code of Civil Procedure §2015.5.
• ⚠Notarizing without valid ID verificationNotary must see current government ID. Without valid ID, notary must refuse — and if they notarize, they commit violation.
• ⚠Lying in affidavitPerjury in California = felony (PC 118), up to 4 years in prison. NEVER exaggerate or invent. If you don't remember with certainty, say "to the best of my recollection".
